Litigating with Other Interests in Foreclosures

Justin Swartz, an attorney in the Orlando office of Bitman O’Brien & Morat, PLLC, recently authored a chapter in Florida Foreclosure Law 2019 entitled “Litigating with Other Interests in Foreclosures.” The Florida Foreclosure Law 2019 book is intended for solo practitioners, litigators, financial institutions, loan servicers, and law libraries as a practical guide to Florida’s rapidly changing law. The latest edition is a Florida practice-focused manual which follows developments in mortgage foreclosure context, default and acceleration, statutes of limitation and repose, standing to foreclose, title considerations, and related litigation. Justin’s chapter in particular focuses on litigation that commonly arises involving the holders of second mortgages, junior liens, and other encumbrances recorded against the subject property, as well as intervening title owners and tenants in possession of the property being foreclosed.

Justin maintains an active and diverse practice throughout Florida, and has experience in all stages of civil litigation involving breach of contract, torts, business disputes, fraud, and real estate matters.
